Can you be fired for being sick in Ireland? Incapacity dismissals, disability and your pay while off

Checked 13 Oct 2026the employment Acts as amended.

Sick leave does not stop a dismissal in Ireland, but dismissal for incapacity needs medical evidence, consultation and a fair procedure, and disability law may require reasonable accommodation first.

Written for employees. This guide covers the Republic of Ireland.

Being ill is hard enough without wondering whether your job will be there when you recover. People search "can you be fired for being sick ireland", "sacked while on sick leave" and "dismissed while on sick leave", and the honest answer is that sick leave is not a shield, but a dismissal for sickness has to clear a high bar. This guide explains that bar, where disability law adds to it, what you are paid in the meantime, how long-term absence is handled, and the clock.

Not automatically unfair

Being on sick leave does not stop an employer from dismissing you, and a dismissal because you cannot do the job is not automatically unfair. "Capability" is one of the fair reasons listed in the Unfair Dismissals Acts 1977 to 2015, and incapacity through illness falls under it.

What the Acts require is that the dismissal be fair in substance and in procedure. The Workplace Relations Commission (WRC) has set out, across many decisions, what a fair incapacity dismissal looks like:

  • the employer acted on up-to-date medical evidence, usually including its own occupational health assessment, not just on the fact of absence
  • you were told that your continued absence was putting your job at risk, and given a chance to respond and to produce your own medical evidence
  • the employer consulted you about when you might return and in what capacity, and considered adjustments or an alternative role
  • the employer weighed its own needs against your service and prospects of recovery
  • a hearing was held, you could be accompanied, and an appeal was offered

A dismissal with none of that, by letter while you were certified unfit, may be unfair even where your absence was long and genuine.

There is a separate category: dismissals that are really about something else. Where an employer uses a sick absence as the occasion to dismiss for a reason it has not disclosed, or dismisses because you took sick leave at all, the real reason is what the WRC examines.

Disability and reasonable accommodation

Many illnesses that cause long absences are disabilities under the Employment Equality Acts 1998 to 2015. The definition is wide and has included long-term physical conditions, mental health conditions, and conditions that come and go. Where it applies, two further rules sit on top of the unfair dismissal rules.

First, disability is one of the nine grounds on which discrimination is unlawful, and dismissal is covered. Second, the employer must take appropriate measures to enable you to do the job, unless those measures would impose a disproportionate burden. That is reasonable accommodation, and the WRC expects the employer to have considered it before concluding that you cannot do the job: adjusted hours, a phased return, equipment, a change of duties or a different role.

A discrimination claim has no 12-month service requirement, is brought at the WRC within six months of the act, and can bring compensation of up to two years' pay that is not tied to financial loss alone. It can be brought alongside an unfair dismissal complaint, though the WRC will not compensate twice for the same loss.

Mental health conditions are disabilities on the same basis. The stress leave guide in the trouble-at-work chapter covers the particular issues there.

Sick pay and Illness Benefit meanwhile

While you are off, three sources of income are possible.

Statutory sick pay. Under the Sick Leave Act 2022, after 13 weeks' service you are entitled to five days' sick pay a year at 70% of your normal pay, capped at €110 a day, with a medical certificate from a registered practitioner from the first day. The planned rise to seven and ten days was paused in 2025 and had not resumed at 13 October 2026; any change is tracked at changes. The sick pay tool works out your daily figure.

Your employer's scheme. Many contracts give more. An employer scheme replaces the statutory one only if, taken as a whole, it is at least as favourable. Read the sick pay clause for how many weeks and at what rate, and whether it is discretionary.

Illness Benefit. From the Department of Social Protection, €254 a week in 2026, subject to PRSI conditions and with three waiting days from the start of the illness. Apply early: it runs from the start of the illness, not from the date your pay stops. The illness benefit guide in the leave chapter covers the application.

Annual leave continues to accrue during sick leave. If you are dismissed, accrued leave is paid in your final pay.

Long-term absence

The question people ask is "how long before they can let me go", and there is no number. The WRC's approach is to look at whether, on the medical evidence, there was a reasonable prospect of your returning within a reasonable time, and whether the employer could reasonably be expected to hold the job open until then.

Factors that have mattered in published decisions:

FactorWhy it matters
A return date in your certificatesAn absence with an end in sight is hard to treat as permanent incapacity
Occupational health opinionThe employer is expected to get one and to act on it, not on its own view
Your length of serviceLong service weighs in favour of waiting
The size of the employerA large employer can usually cover an absence longer than a small one
Alternatives consideredA phased return, reduced hours or a different role
Contact during absenceRegular, supportive contact counts for the employer; silence then a dismissal letter does not

If your employer asks you to attend its occupational health doctor, attending is generally expected, and refusing without reason weakens your position. You can ask for a copy of the report and you can give your own doctor's report in response.

Where absence is intermittent rather than continuous, employers use absence management procedures with trigger points and review meetings. Those meetings are part of the procedure: attend, bring someone, and put your medical position in writing.

If you are dismissed

Ask in writing for the statement of reasons the Unfair Dismissals Acts entitle you to; it must be given within 14 days. Ask for the medical reports the employer relied on and the minutes of any meetings. Use the appeal.

You are owed notice or pay in lieu of one to eight weeks by service, or the longer contractual period, unless the dismissal is for gross misconduct, which a sickness dismissal is not. Notice runs even if you are too ill to work it. The notice tool gives the figure and the wrongful dismissal and notice pay guide explains the claim.

If you were dismissed in the first 12 months, the dismissed on probation guide covers what remains, and the disability route above is the one to look at first.

If you resigned because the way your illness was handled made staying impossible, that may be constructive dismissal, but the grievance procedure should have been used first.

The clock

Each complaint has its own six months:

  • Unfair dismissal: six months from the date of dismissal, extendable to 12 months for reasonable cause and never beyond. Being ill can be reasonable cause for a delay, but only where the illness actually prevented you from lodging the complaint; say so with medical evidence.
  • Discrimination: six months from the date of the discriminatory act, extendable to 12.
  • Minimum notice and unpaid wages: six months from the date of dismissal or the pay date.

The complaint is one online form with no fee, mediation is free and offered first, and the WRC does not award costs. If the employer offers a sum to go, read the settlement agreements guide first: the waiver will cover the disability claim as well.

Where this leaves you

Use the sick pay tool to see what you are owed while you are off: statutory sick pay, your employer's scheme and when Illness Benefit starts. If you have been dismissed, the unfair dismissal tool checks your service and the deadline.

If you are in a union, ring them first: an official can attend the absence meetings with you and will know how the employer has handled long absences before. See union. Where a disability is involved, or the dismissal came by letter with no process, a solicitor can assess the equality claim, which is often the stronger one.

Frequently asked questions

Can you be sacked while on sick leave in Ireland?

Being on sick leave does not protect you from dismissal, and a dismissal for incapacity can be fair. But the employer has to show it acted on medical evidence, consulted you, considered when you might return and looked at alternatives, and it has to follow a fair procedure. A dismissal that skips those steps may be unfair.

Can I be dismissed while on sick leave with less than a year's service?

The Unfair Dismissals Acts generally need 12 months' service, so a dismissal in the first year is harder to challenge under them. Where the illness is a disability, a discrimination claim under the Employment Equality Acts has no service requirement, and notice pay is owed after 13 weeks' service in any case.

How long can you be on sick leave before dismissal in Ireland?

There is no fixed period. The question the WRC asks is whether, on the medical evidence, you were likely to return within a reasonable time and whether the employer could reasonably be expected to wait. Long absences with no prospect of return have supported dismissal; absences with a return date in sight generally have not.

What am I paid while I am off sick?

Statutory sick pay of 70% of your normal pay, capped at €110 a day, for five days a year, after 13 weeks' service and with a medical certificate from day one. After that, Illness Benefit from the Department of Social Protection, €254 a week in 2026 subject to PRSI conditions, with three waiting days. A better employer scheme replaces the statutory one.

Is an illness a disability under Irish law?

Disability under the Employment Equality Acts is defined widely and has included long-term physical and mental health conditions. Where it applies, the employer must consider reasonable accommodation before dismissing, unless the measures would impose a disproportionate burden, and a dismissal without that step may be discriminatory as well as unfair.
